Welcome to GildSafe. These Terms of Service (“Terms”) govern your use of the GildSafe website, mobile applications, and related services (collectively, the “Services”).

The Services are operated by GildSafe LLC (“GildSafe,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to these Terms. If you do not agree, you may not use the Services.

1. Description of Services

GildSafe provides a digital platform that allows users to:

  • register and document ownership of valuable items
  • store photographs and documentation related to those items
  • report items as lost or stolen
  • participate in a community reporting and recovery network
  • receive notifications related to potential item recovery

GildSafe acts solely as a technology platform and registry service and does not take possession of items or act as a broker, insurer, authenticator, appraiser, or law enforcement authority.

2. Eligibility

You must be at least 18 years old to create an account or use the Services.

By using GildSafe, you represent and warrant that:

  • you are legally capable of entering into these Terms
  • you have the legal right to register any items you upload
  • the information you provide is accurate and not misleading

3. User Accounts

To use certain features of the Services, you must create an account.

You agree to:

  • provide accurate and complete information
  • maintain the confidentiality of your login credentials
  • promptly notify GildSafe of unauthorized account access

You are responsible for all activity occurring under your account.

GildSafe reserves the right to suspend or terminate accounts suspected of misuse, fraud, or violation of these Terms.

4. Item Registration

Users may upload information regarding personal property they own or control.

You represent and warrant that:

  • you are the lawful owner of the item or authorized to register it
  • the information you provide is accurate and truthful
  • the item is not knowingly misrepresented

GildSafe does not independently verify ownership claims submitted by users. Registry records are based solely on information provided by users.

5. Ownership Disputes

GildSafe is not responsible for determining legal ownership of any item registered on the platform.

If a dispute arises regarding ownership, GildSafe may:

  • temporarily restrict the registry record
  • remove or disable the listing
  • request supporting documentation

GildSafe may rely on court orders, law enforcement requests, or other legal determinations when resolving disputes. GildSafe shall not be liable for losses resulting from ownership disputes.

6. Reporting Lost or Stolen Items

Users may report items as lost or stolen.

By submitting such reports you represent that:

  • the report is truthful
  • it is made in good faith
  • you reasonably believe the item is lost or stolen

Submitting a false report may result in account suspension, removal of registry records, and potential legal liability.

7. Recovery Network and Tips

Users or third parties may submit information (“Tips”) regarding lost or stolen items.

GildSafe does not guarantee the accuracy of tips or that lost or stolen items will be recovered. Users rely on tip information at their own risk.

8. Bounty Rewards Program

GildSafe may allow users to offer monetary rewards (“Bounties”) for information leading to the recovery of items reported as lost or stolen.

The Bounty program is intended to encourage credible information that leads to the safe recovery and return of registered property.

GildSafe acts solely as a facilitator and administrator of the bounty process.

Creation and Funding of a Bounty

A registered user (“Item Owner”) may choose to offer a bounty in connection with a lost or stolen item.

The Item Owner determines the bounty amount and is solely responsible for funding the bounty.

To activate a bounty, 100% of the bounty amount must be transferred to an account designated and controlled by GildSafe using an approved payment method such as wire or ACH transfer.

The bounty will not be displayed or activated until the full bounty amount has been received and confirmed by GildSafe.

Administrative Holding of Bounty Funds

Bounty funds transferred to GildSafe are held solely for the administrative purpose of operating the bounty program.

GildSafe is not a bank, escrow provider, trustee, or fiduciary, and the transfer of bounty funds does not create an escrow, trust, or fiduciary relationship.

GildSafe assumes no fiduciary obligations with respect to bounty funds and shall not be liable for disputes regarding their administration or release.

Submission of Tips

Individuals may submit Tips regarding the location or recovery of a lost or stolen item through the platform.

Submitting a Tip does not automatically entitle the individual to receive a bounty.

Conditions for Bounty Eligibility

A Tip may qualify for a bounty only if:

  • it provides new and credible information
  • the information directly leads to the verified recovery of the item
  • the item is returned to the lawful owner
  • the Tip provider was not involved in the theft or unlawful possession of the item

If multiple Tips are submitted, the Item Owner may determine which Tip led to the recovery.

Criminal Participation Disqualification

Individuals are not eligible to receive a bounty if they participated in or assisted with the theft, concealment, possession, or sale of the item.

GildSafe may deny bounty payment if there is reasonable evidence that the Tip provider was involved in the theft or unlawful possession of the item.

GildSafe may also provide relevant information to law enforcement.

Verification of Recovery

Before any bounty funds are released, recovery of the item must be reasonably verified. Verification may include documentation, photographic evidence, serial number confirmation, or confirmation from law enforcement or recovery partners.

Payment of Bounty Funds

If a qualifying Tip leads to verified recovery of the item, bounty funds held by GildSafe may be released to the Tip provider.

Payments are made exclusively from bounty funds previously provided by the Item Owner. GildSafe does not fund or sponsor bounty rewards.

Delayed Payment and Investigation

GildSafe may delay the release of bounty funds if additional verification or investigation is necessary.

Payment may be delayed in situations including:

  • multiple Tip claims
  • disputes regarding eligibility
  • ownership disputes
  • pending law enforcement investigations
  • suspected fraud or misrepresentation

GildSafe may retain bounty funds while investigations are conducted and may require additional documentation before determining eligibility.

Recovery Safety and Conduct

GildSafe does not encourage or authorize individuals to attempt to physically recover stolen property or confront suspected thieves.

Participants must comply with applicable laws and should not engage in actions that could endanger themselves or others.

Participation in the bounty program is voluntary and undertaken at the participant's own risk.

9. Dealer and Marketplace Safe Harbor

Dealers, buyers, marketplaces, and other third parties acknowledge that registry information is user-submitted and may not be independently verified.

GildSafe does not guarantee authenticity or ownership of registered items. Reliance on registry data is at the user's own risk.

10. No Authentication or Valuation Services

Unless explicitly stated, GildSafe does not authenticate, appraise, or verify the authenticity of registered items.

11. Fees and Payments

Certain features of the Services may require payment of fees, including setup fees, subscription fees, reactivation fees, or other charges disclosed through the Services.

Applicable fees, billing terms, and payment obligations will be presented to you at the time of purchase, signup, upgrade, reactivation, or renewal.

By purchasing or subscribing to any paid feature of the Services, you agree to pay all applicable fees and charges then in effect.

Unless otherwise expressly stated, all fees are non-refundable.

Payments are processed through third-party payment providers. By submitting payment information, you authorize GildSafe and its payment processors to charge the applicable payment method for all amounts due.

GildSafe reserves the right to change its fees, pricing structure, billing methods, or paid features at any time upon reasonable notice.

If recurring billing applies, you authorize GildSafe or its payment processor to charge your payment method on a recurring basis unless and until you cancel in accordance with the applicable cancellation terms.

You are responsible for providing accurate billing information and for any taxes associated with your use of paid Services.

12. Prohibited Uses

You agree not to:

  • register items you do not legally own
  • submit fraudulent information
  • impersonate others
  • engage in unlawful activity
  • interfere with platform operations

Automated Access and Data Scraping

You may not use automated systems, bots, crawlers, or scraping tools to:

  • extract registry information
  • harvest serial numbers or ownership records
  • copy user-submitted content
  • compile databases from platform data

Platform data may not be used to train artificial intelligence systems or build competing products without written permission from GildSafe.

13. Intellectual Property

All platform software, design, trademarks, and content are owned by GildSafe or its licensors.

Users retain ownership of uploaded content but grant GildSafe a limited license to store, display, and process that content for purposes of operating the Services.

14. Registry Database Ownership

While users retain rights to their submitted content, the compilation and structure of the GildSafe registry database constitute proprietary intellectual property of GildSafe.

Unauthorized reproduction of the registry database is prohibited.

15. Stolen Item Alert License

By registering items or reporting items as lost or stolen, users grant GildSafe permission to share relevant item information with law enforcement, dealers, marketplaces, insurers, and recovery partners for the purpose of assisting with recovery.

16. Law Enforcement Cooperation

GildSafe may cooperate with law enforcement or regulatory authorities in investigations involving stolen property or fraud and may disclose registry information in response to lawful requests.

17. Service Availability

GildSafe may modify or discontinue platform features at any time. Services are provided without guarantee of uninterrupted availability.

18. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

19. Limitation of Liability

GildSafe shall not be liable for loss of property, failure to recover stolen items, reliance on registry information, or disputes between users.

Total liability shall not exceed the amount paid to GildSafe during the previous 12 months.

20. Indemnification

You agree to indemnify and hold harmless GildSafe from claims arising from your use of the Services or violation of these Terms.

21. Termination

GildSafe may suspend or terminate accounts that violate these Terms.

22. Dispute Resolution and Arbitration

Disputes must first attempt informal resolution.

Unresolved disputes will be handled through binding arbitration administered by the American Arbitration Association (AAA) in Miami, Florida.

Class actions are waived and disputes must be brought individually.

23. Governing Law

These Terms are governed by the laws of the State of Florida. Non-arbitrated disputes shall be handled in courts located in Miami-Dade County, Florida.

24. Changes to Terms

GildSafe may update these Terms from time to time.
